Can I Place a Dumpster in the Street in Doraville?

What is allowed?

Renting a dumpster for medium to large home clean-outs and other projects is an excellent idea. We are very flexible about where we set our dumpsters, however, we still must comply with city, county and state laws. If the driveway is large enough we can almost always place a dumpster on private driveways, and parking areas. Some cities or counties will allow dumpsters to be placed on a curb or in city streets either with or without a permit, however, there are some that do not allow dumpsters to be placed anywhere besides private property.

What is not allowed?

The City of Doraville does not allow dumpsters to be placed on any public property such as the street, or sidewalk. They do this in order to promote safety for all their residents of Doraville. If a dumpster were placed on street, it could block the vision of drivers and cause harm to others. Even though Doraville City only permits dumpsters on private property there are benefits. A benefit to putting a dumpster on private property versus the street is it will decrease the amount of unlawful dumping. Although unlawful dumping may not seem like an issue it can quickly become an one to you, the person who rented the dumpster because if there are restricted items put in the dumpster the renter could be charged additional fees and may be forced to dispose of the item(s) separately.

Sec. 17-6. – Obstructions to right-of-way.

    1. Prohibited. It shall be unlawful for any person to obstruct the right-of-way of any public road, street or other easement in the unincorporated area of the county by placing or maintaining thereon any obstruction, whether it is in the nature of shrubbery, signs, fences or whatever, which interferes with the clear view of motorists or the free passage of pedestrians thereon.
    2. Notice to remove. Wherever any obstruction prohibited by subsection (a) has been placed and is being maintained, the police department shall notify in writing the owner of the obstruction and the owner of the land abutting the right-of-way where the obstruction is found and also the person in possession of the property. Such notice shall state the nature of the obstruction and the fact that the obstruction is an interference with the clear view of motorists or the free passage of pedestrians and that it shall be removed within ten (10) days from the date of the notice.
    3. Issuance of summons upon failure to remove. Whenever the person so notified as provided by subsection (b) of this section fails or refuses to remove the obstruction within the time allowed in the written notice, the police department shall issue a summons to this person to appear in recorder’s court on a day certain to stand trial for the violation.
    4. Continued violations; issuance of summons without notice. If upon conviction for the first offense the person continues to refuse to remove the obstruction, each day that it remains intact shall constitute a new violation of subsection (a) of this section for which the police department shall issue a summons, without first issuing the written notice.
